Terms of Service

These Terms govern your use of kwik.’s website platform, website setup, hosting, subscription services, and this website. By purchasing a service, starting a subscription, booking a call, or otherwise engaging kwik., you agree to these Terms.
1. Who You’re Contracting With
kwik. is operated by NUBYTECH (Pty) Ltd (Registration No. 2024/113512/07), trading as Nubytech Foundry. References to “kwik.”, “we”, “us”, or “our” throughout these Terms mean NUBYTECH (Pty) Ltd.
2. Our Services
kwik. provides website setup, website hosting, access to a website platform, and related ongoing website services for businesses.
Depending on the plan or service selected, this may include the creation and setup of a website, hosting, website access, maintenance, updates, and other features described on our website or agreed with you.
The exact features, deliverables, pricing, and any applicable limitations of your service are those described at the time of purchase or otherwise agreed with you in writing.
3. Pricing and Payment
Current pricing is displayed on our website or provided to you before purchase. Prices may change from time to time, but changes will not normally affect a billing period that you have already paid for.
- Subscription plans: If you purchase a monthly or other recurring plan, you agree to recurring billing at the stated billing interval until the subscription is cancelled.
- One-time payments: Some services, setup fees, promotional offers, or additional services may be charged as a one-time payment.
- Payment providers: Payments may be processed through authorised third-party payment providers. The available payment methods will be shown to you at checkout.
- Recurring billing: By starting a subscription, you authorise us or our payment provider to charge the applicable subscription amount at each billing interval until you cancel, subject to applicable law and the payment provider’s terms.
4. Subscription Renewals and Cancellation
Your subscription will continue and renew automatically at the applicable billing interval unless cancelled before the next renewal date.
You may request cancellation at any time. Unless otherwise stated at the time of purchase, cancellation will prevent future subscription renewals, and your website and service will normally remain available until the end of your current paid billing period.

5. Timelines
Any estimated delivery timelines, such as “48 hours” or “72 hours,” begin once we have received all information, content, assets, approvals, and other materials reasonably required to begin the work.
Delays in receiving content, feedback, or approvals may extend the estimated delivery timeline.
6. Revisions and Changes
Where a service or package includes revisions, the number and scope of those revisions will be as described in the applicable package or agreed with you.
Changes outside the original agreed scope may require additional time or payment.
7. Your Responsibilities
You are responsible for:
- Providing accurate and complete information needed to deliver your website or service.
- Providing content, images, logos, text, and other assets within a reasonable time.
- Ensuring that you have the necessary rights or permissions to use any content you provide to us.
- Reviewing and approving your website content and information before or after publication where reasonably requested.
8. Non-Responsive Clients
If we are waiting for content, feedback, approval, or other information from you, your website build or requested updates may be paused until you respond.
Your active subscription may continue to be billed during this period where your website, hosting, platform access, or other subscribed services remain available.
If we do not hear from you for 90 consecutive days, we may treat the project as inactive or abandoned and may pause, suspend, or cancel the relevant service after reasonable notice where appropriate.
9. Ownership and Intellectual Property
kwik. operates on a subscription-based model. Your subscription pays for the services, hosting, platform access, and website use described in your selected plan. Ownership rights are subject to the terms below.
- During the subscription period: Unless otherwise agreed in writing, the website code, underlying platform, and other materials created or provided by kwik. remain the property of NUBYTECH (Pty) Ltd or its applicable licensors. You receive the right to use your live website while your subscription remains active and paid up.
- Transfer after 12 months: After 12 consecutive months of qualifying on-time subscription payments, ownership of the website and associated domain may transfer to you in accordance with the applicable plan and service agreement.
- On-time payments: A payment is considered on-time if it is successfully received within 5 days of its due date.
- Late or missed payments: A payment received more than 5 days after its due date may break the consecutive 12-month payment period. We may also suspend or cancel services where payments remain overdue.
- Cancellation before transfer: If you cancel before meeting the applicable ownership transfer requirements, ownership of the website and domain may not transfer to you. The treatment of your website and domain following cancellation will be subject to these Terms and any applicable service agreement.
- Your content: You retain ownership of content, logos, trademarks, and other materials that you provide to us, provided that you have the rights to use them.
- Portfolio rights: Unless you request otherwise in writing, we may display completed or active projects in our portfolio, website, or marketing materials.
10. Service Availability
We will use reasonable efforts to keep our services available and functioning. However, websites, hosting providers, payment services, and other internet-based systems may occasionally experience interruptions, maintenance, or technical issues.
We do not guarantee uninterrupted or error-free operation at all times.
11. Limitation of Liability
kwik. will make reasonable efforts to provide the services described in your selected plan. However, we do not guarantee specific business outcomes, including a particular number of sales, leads, customers, visitors, or search engine rankings.
To the extent permitted by applicable law, kwik. will not be liable for indirect, incidental, special, or consequential losses arising from your use of our services.
12. Suspension or Termination
Either party may end an ongoing service in accordance with these Terms and any applicable cancellation process.
We may suspend or terminate a service where reasonably necessary, including for non-payment, unlawful use, abuse of the service, or a material breach of these Terms.
Any applicable refunds will be handled in accordance with our Refund Policy and any rights that apply under applicable law.
13. Changes to These Terms
We may update these Terms from time to time. The latest version will be published on our website with an updated revision date. Where required, we will provide additional notice of material changes.
14. Governing Law
These Terms are governed by the laws of South Africa, subject to any consumer rights or other legal protections that may apply to you.
